Welcome to Buskeros. These Terms and Conditions ("Terms") govern access to and use of buskeros.com, our applications, and related services (the "Service"), operated by Buskeros ("Buskeros", "we", "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What Buskeros is Buskeros is a marketplace that connects professionals, service providers, employers, and clients across Central America, the Caribbean, and the United States. We facilitate contact between users and, for paid services, payment processing. We are not a party to the agreements users enter into with each other, and we are not an employer, employment agency, or representative of any user.

2. Eligibility and account You must be an adult (18 years old) or, at minimum, over 16 where applicable law permits, to use the Service. You are responsible for keeping your credentials confidential and for all activity on your account. You must provide accurate information and keep it up to date.

3. User content and conduct You are solely responsible for the content you post (profile, resume, services, jobs, messages, and more). By posting content you grant Buskeros a worldwide, non-exclusive, royalty-free license to host, display, and distribute it for the purpose of operating and promoting the Service. You may not post content that is false, fraudulent, misleading, illegal, defamatory, offensive, that infringes third-party rights, or that constitutes spam. We reserve the right to review, moderate, and remove content, and to suspend accounts that violate these Terms.

4. Services, jobs, and bookings Users post services and jobs under their own responsibility. Buskeros does not guarantee the accuracy, quality, legality, or suitability of listings, or the outcome of any booking. You must evaluate the other party on your own before hiring or being hired.

5. Payments, escrow, and fees For paid services processed through the Service: - Payments are processed through our payment provider (Stripe). When you pay, the amount is held by the platform (escrow) until the work is delivered and the client accepts it, or until the automatic-acceptance period elapses. - Buskeros charges a service fee on each completed transaction (12% by default, or 8% for Pro-plan providers), with a minimum fee where applicable. The fee is deducted before the amount is transferred to the provider. - When the delivery is accepted, or the automatic-acceptance period elapses, the net amount is transferred to the provider. Refunds, partial refunds, and releases are handled as set out in these Terms and the order flow. - Prices and amounts are shown and charged in the stated currency. Any applicable taxes are your responsibility.

6. Buskes (credits) Buskes are in-Service virtual credits you can earn or acquire to access certain features. Buskes are not legal tender or a financial instrument, do not earn interest, and, unless expressly stated, are not redeemable for cash. We may adjust their value, features, and validity; use of Buskes is governed by the rules in effect in the Service.

7. Provider payouts To receive payments, providers must complete payout onboarding with our payment provider (Stripe Connect) and accept its terms. The provider is responsible for its own tax and legal obligations arising from income earned through the Service.

8. Disputes between users If a dispute arises over a paid order, either party may open it within the Service; the amount stays held while it is reviewed. Buskeros may, at its discretion and as an intermediary, resolve the dispute by releasing the funds, refunding them fully, or refunding them partially, based on the available information. This mediation does not make Buskeros a party to the agreement between the users.

9. No circumventing the platform For bookings initiated on Buskeros, you may not deliberately move the transaction or payment off the Service to avoid fees, or share contact details prematurely in order to bypass the platform. Such conduct may result in account suspension.

10. Intellectual property The Service, its software, trademarks, design, and content (excluding user content) are owned by Buskeros or its licensors and are protected by law. You may not copy, modify, distribute, or create derivative works without authorization.

11. Third-party services The Service relies on external providers (for example, Stripe for payments, and messaging and analytics services). Use of those features may be subject to those third parties own terms.

12. Disclaimer The Service is provided "as is" and "as available," without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free, and we are not responsible for the conduct of other users.

13. Limitation of liability To the extent permitted by law, Buskeros will not be liable for indirect, incidental, or consequential damages, or for loss of profits, data, or opportunities, arising from use of the Service or from agreements between users. Our total liability is limited, to the extent permitted by law, to the fee amounts you paid us in the three months before the event giving rise to the claim.

14. Indemnification You agree to hold Buskeros harmless from claims arising out of your content, your use of the Service, or your breach of these Terms.

15. Suspension and termination We may suspend or close your account if you violate these Terms or the law, or to protect the Service and other users. You may close your account at any time. Provisions that by their nature should survive will remain in effect after termination.

16. Changes to the Terms We may update these Terms from time to time. We will post the current version on this page with the last-updated date. Continued use of the Service after a change means you accept it.

17. Governing law These Terms are governed by the law applicable in the jurisdiction where Buskeros is established, without prejudice to the rights granted to you by the mandatory law of your country of residence.
